What Is a Pro Se Appeal?

A pro se appeal is when an individual who lost a case in a lower court decides to challenge that decision in a higher court without legal representation. This can occur in civil; criminal, agency, or prisoner claims cases.


Pros of Pro Se Appeal

  1. Cost Savings   You avoid attorney fees, which can be prohibitively expensive—especially in lengthy appeals.

  2. Personal Investment   No one is more motivated than the wrongfully convicted person themselves. You may be more committed to uncovering errors and presenting your case thoroughly.

⚖️ What Is a Wrongful Conviction?

A conviction is considered wrongful when:

  • The person is factually innocent of the crime.

  • There were procedural errors that violated their rights during investigation or trial

  • Eyewitness misidentification: Mistaken identity is a leading cause.

  • False confessions: Often due to coercive or prolonged interrogations.

The Fight Is Never Over We Are Here For You!!!

James Jenkins – Incarcertated

Mr. Jenkins was convicted of second-degree murder, two counts of attempted murder, two counts of attempted assault, and two counts of weapon possession on April 9, 1988, in relation to a shooting that took place in Brooklyn in 1986.  No physical evidence connected Mr. Jenkins to the crime. Former detective Louis Scarcella was the lead detective on the case. Scarcella’s misconduct is all over this case: he showed witnesses a photo of only Mr. Jenkins instead of conducting a photo array, he conducted a show-up when he could have conducted a lineup, and he took very few notes about his interactions with the witnesses. The trial judge ultimately precluded everything Scarcella did. However, several witnesses were still permitted to testify because they claimed they had previously known Mr. Jenkins and therefore, could properly identify him. The…

James Jenkins has been incarcerated since 1986 for a Brooklyn murder he says he didn’t commit. Despite no physical evidence and key witness recantations, Judge Sharen Hudson recently upheld his conviction after a two-year hearing. The case was originally led by disgraced detective Louis Scarcella, whose tactics have been linked to multiple wrongful convictions. During the May 2024 ruling, Jenkins and his attorney passionately objected in court, and supporters erupted in protest. Jenkins remains imprisoned and could be held until 2042 unless further legal action succeeds.

We’re calling on advocates, journalists, and justice reform allies to help amplify James Jenkins’ story. Public pressure and media attention are critical to overturning this injustice. Please consider sharing his case, connect with joining our efforts to demand accountability and exoneration.
